General Terms and Conditions (AGB)

The Derag bonus & more Card ("Derag Card") is operated by bonus & more GmbH. The following Participation Conditions apply to participation in the Derag Card program. Use of the Derag Card advantages and acceptance of the agreement commence on application and receipt of the application by bonus & more GmbH. Any natural person over the age of 18 may become a Derag Card cardholder. The Derag Card must be signed upon receipt and cannot be transferred to any other individual. As part of the Derag Card program the cardholder shall be granted bonuses on purchase in the form of credits or immediate cash discounts (in Euro) by bonus & more partner companies, as well as credits on overnight stays in Derag hotels in the form of bonus points. Bonus & more GmbH shall administer bonus entitlements accrued and spending of bonus points.
 
The cardholder shall be credited 3 bonus points per 10.00 Euro of charges for every overnight stay in a Derag apartment or hotel room. The cardholder may use these points to purchase goods as soon as the bonus points account contains the number of bonus points required for the award concerned. Insofar as specified by the award catalogue awards can be acquired using bonus points. The awards may only be acquired on the terms and conditions stated in the awards offers as well as subject to time and quantity limitations stated. The awards may only be sent to the address given by the cardholder as his current delivery address. Euroland shall not be liable for negative consequences resulting from failure to state a change of address or provision of an incorrect change of address. Awards may not be returned or exchanged, with the exeption of claims arising from defects and in cases covered by legal rulings. Credited bonus points may be cancelled if the Participation Conditions are breached, the preconditions for a credit do not apply (e.g. non-payment of an overnight stay), an incorrect booking is made, or the cardholder abuses his card. In the event of termination by the cardholder the bonus points accrued must be exchanged for award goods, otherwise these points shall expire 6 months after termination. In the event of a legitimate termination without notice by Derag, a Derag hotel or by bonus & more GmbH, the bonus points will expire when your Derag card is cancelled. Bonus points must be redeemed within 24 months from the date on which they have been awarded to the relevant bonus & more points account. The bonus points will expire with the expiry of the relevant period. The date of expiry of the points and the period will not be specially referred to when viewing your personal bonus & more points account. All bonus points collected before 01/10/2008 will expire on 30/09/2010. Bonus points accrued in Euro shall not be credited to the bonus account or any payment of the corresponding value made.

The Derag Card also entitles the cardholder to use the bonus & more program and the services of bonus & more online cooperation partners in the internet and on the spot from regional specialist retailers and service companies as per bonus & more conditions. The cardholder confirms that all details given are correct and that he will inform bonus & more GmbH immediately of any changes to his basic details. Should this not be the case correct sending of an award may, for example, not be possible. Credits for online orders and booking of services of online partners in the internet are generally awarded to the cardholder's bonus & more account 6 to 8 weeks after the transaction. In the case of on-the-spot purchases from regional service partners who are described as such on the homepage, immediate discounts or other bonuses shall be granted on presentation of the Derag Card. Derag Card holders are entitled to all current services listed in full in the overview available at the cardholder's service centre on the Derag Card homepage. Bonus entitlements from 15.00 Euro upwards will be transferred to the cardholder's bank account at the end of the quarter; bonus entitlements from 5.00 Euro upwards at the end of the year. Smaller sums will be accrued. Bonus & more GmbH charges a fee to the sum of 0.60 Euros per transfers in Germany and Austria and 2.00 Euro per transfer for all other countries.
 
In case of loss of the Derag Card the customer services department must be informed immediately in writing to the address: bonus & more GmbH, Leonhardstrasse 16-18, D-90443 Nürnberg or by telephone under the service hotline +49 / 180 / 5 95 05 58 (0.14 Euro/min.). Issue of a new card will be subject to a charge of 3.00 Euro.

The fee for the Derag Card is 75.00 Euro (incl. legal VAT rate) per year. In Germany and Austria following issues of the card this sum can be debited for the first time from the bank account stated in the application and will be debited from this account in all subsequent years until written notice is given. Direct payment by credit card is possible in all countries. The contract shall be valid for an initial 12 months, commencing from the application date on the card application and shall automatically be extended for periods of a further year, unless notice is given at least three months before the end of the subscription year. In order to administer and operate the program bonus & more GmbH shall collect, store and use he cardholder's personal details and, insofar as required for performance of the contract, passed on to bonus & more service partners. Bonus & more GmbH shall not be liable to the cardholder should a service partner fail to honour a payment obligation, assuming that this is not due to negligent behaviour on the part of bonus & more GmbH. The relevant laws of the Federal Republic of Germany shall be valid for this contract. Alterations and additions to the Participation Conditions shall be viewed as accepted if the cardholder does not cancel the contract within 4 weeks of notification of the alteration or if the Derag Card continues to be used.
