Derag Hotel and Living - Terms and Conditions of Online Orders

Order, delivery, payment [top]

Delivery shall take place after completion of credit card payment. Delivery deadlines are without guarantee. In general, delivery takes place within 3 working days.

Contract closure [top]

A contract between the buyer and the seller is reached when the buyer places an order with the seller and the seller accepts this order. The buyer's order takes place through transmission of the fully completed online order form. The seller accepts the order by delivering, i.e. handing over, the voucher to the shipper/mail service. Order confirmation is sent to the buyer via e-mail immediately after the order is received. This represents only that the seller has received the order - not that the contract has been accepted.

Right to revocation, return, guarantee [top]

The buyer can return the sales contract within two weeks of voucher receipt - insofar as it has not been redeemed - without any reason. The buyer need only return the voucher. Prompt return of the voucher is sufficient for complying with the deadline. The buyer is responsible for the costs of return postage.

The seller is responsible for immediate inspection of the voucher upon its arrival. In case of incorrect or incorrectly issued vouchers, the seller must be notified in writing within 8 days. In the case of legitimate complaints, the buyer shall have the choice of rectification of defect, replacement or refund.

Conditional sale, data protection, legal domicile [top]

The voucher shall remain the property of the seller until its complete payment. Customer data shall be stored and processed in compliance with all regulations of the Federal Data Protection Act.

Data necessary for completion of the transaction shall be stored in the accounting software of Derag Hotel and Living AG and handled confidentially. No personal data will be relayed to third parties. The only exception to this shall be service-partners (shippers, couriers) who require this data in order to complete the order procedure. By submitting an order, the customer expressly agrees to this data collection and its processing and use.

The customer is entitled to information and has the right to correction, blocking and deletion of his/her personal data. An informal e-mail to » webmaster@derag.de is sufficient for this.

Any disputes arising hereunder shall be settled before a competent court of law located in the seller's place of residence. This agreement is subject to the laws of the Federal Republic of Germany.

Final clause [top]

In the event that individual parts of these General Terms and Conditions should be or become ineffective, the remaining parts shall remain unaffected.
